70 Years of the Basic Law for the Federal Republic of Germany (May 24, 1949)

On May 24, 1949 the Federal Republic of Germany’s Basic Law goes into effect. It had been approved by the Parliamentary Council and sanctioned by the Allies two weeks earlier. Over the course of nine months representatives of the newly reinstated parties had worked out a legal and political order for a democratic state in the “Western zone”. They deliberately avoided the term “constitution” as the preamble emphasizes the provisional character of the work, which was to be an interim arrangement until Germany would be reunited.

The fundamental rights in the first 19 articles receive special attention. They reflect the values of the Federal Republic of Germany. With the ghost of National Socialism still looming in the background these rights are meant to protect the citizens from the state with so-called “defence rights”, and to protect the individual’s sphere of freedom from infringement by public authorities. This includes human rights, such as dignity of man and freedom of expression. The following articles lay down the central principles that reflect the essence and organization of the state.

The basic law takes precedence above all other laws and can only be amended by a two-thirds majority in the Bundestag as well as in the Bundesrat. Ever since its passage there have been around 60 modifications. The most important ones came with the re-introduction of military conscription and the creation of the Federal Armed Forces in 1956, as well as the ratification of the emergency law in 1968, which was accompanied by massive protests from the extra-parliamentary opposition.

In the course of the German reunification a debate ensues about a pan-German constitution. In the end the existing basic law undergoes only minor changes and is basically just broadened to include the territory of the former German Democratic Republic.
